Website registration terms and conditions

When you register for or use any of the following OnePath Insurance websites:

  • Adviser Advantage; or
  • Customer Centre

 

(each of them "the Site" and collective "the Sites"), you are agreeing to be bound by the following terms and conditions as well as those set out in the Terms of Use including the OnePath Privacy Policy. Please ensure you understand them before you register for or use the Site.

In these Website registration terms and conditions, a reference to “we”, “us” and “our” refers to “OnePath Insurance”, and its related bodies corporate and its and their authorised agents or services providers. OnePath Insurance consists of the following entities:

  • Zurich Australia Limited ABN trading as OnePath Life 92 000 010 195; AFSL 232510
  • OnePath General Insurance Pty Limited ABN 56 072 892 365; AFSL 288160

1. Security

(a)  We will send you a Password and UserId. To maintain security you must keep your Password and UserId confidential and store them separately at all times. You must not disclose your Password or UserId to any other person. Your Password should be changed regularly to maintain confidentiality. Access to the Site will be given on the correct entry of a UserId and Password. Once access is granted, all actions taken through your UserId and Password (until you 'log out') will be treated as having been made by you or on your behalf and with your authority unless

  1. the action is taken after you have notified us of a compromised UserId and Password or
  2. the access was not within your knowledge or consent (and where relevant, the knowledge or consent of your staff) and you did not contribute in any way to the third party being able to use your UserId or Password (e.g. by providing them to the third party), or
  3. the action was the result of any instruction or action by Us or our staff.

 

If you believe that your UserId and Password have been compromised, please contact us immediately on 1800 290 685.

(b)  Please note that this section (b) applies to users of the Adviser Advantage only. If requested by you, we may send you an additional Password and UserId for use by a member of your support staff. You must ensure that your support staff adheres to the security requirements set out in section (a), and you are responsible for any breach of such requirements by your staff member. You must notify us when any member of your support staff who has a Password and UserId leaves your employment.

2. Authorised use

You are authorised to access the Site for reference and reporting purposes only. You may not modify any of the data contained in the Site. If you are an adviser, you may reproduce the data in a report which you provide to a client to whom that data relates, and you may add your own comments in relation to the data. Except as expressly stated, we retain all intellectual property rights.

3. Indemnity

You agree to indemnify us against any claim, loss, cost, damage, action or expense which we or any other user may experience arising from your failure (including any failure by any member of your staff) to comply with these terms or keep your Password confidential except to the extent that the claim, loss, cost, damage, action or expenses is contributed to by Us or our staff.

4. Liability of OnePath Insurance

The Site may allow you to access information on your account through your reports and provides information including asset allocation, unit prices and performance. While we will take all reasonable steps to ensure the information provided on the Site is accurate and up to date at the relevant date, to extent permitted by relevant law, we will not be liable for any loss or damage arising from: any omission, error or inaccuracy in information provided on the Site; any unauthorised access to information on the Site (including your portfolio details); the unavailability of the Site or the failure of any function of the Site to perform in whole or in part.

5. Changes to the Site

We reserve the right to change, remove or add to the information provided by the Site and to limit access or cease providing information on the Site.

6. Change of conditions

We reserve the right to change the terms and conditions of use for the Site without prior written notification but such change will only apply to the use of the Site after we have provided the terms to you or updated the link from the Site to the new terms and conditions.

7. Denial of access

We reserve the right to suspend access to the Site and/or particular account details including where: you fail to keep your UserId and Password or the UserId and Password of a member of your support staff secure; or in our opinion, there are concerns regarding security or unauthorised access.

8. Internet access and electronic communications

While we have put in place certain security systems on the Site, we are unable to guarantee in all circumstances that the Site or the information contained on the Site will not be subject to unauthorised access. We will not be liable for any loss, damage, claim or expense arising from any unauthorised access to the Site or the information (including client records) contained in the Site. Whilst we may request that you indicate your preferences for receipt of email or other electronic communications, we reserve the right to communicate to you any business critical information or other information that we are required by law to communicate to you e.g. product disclosure statement 'opt-in' notifications to advisers as required by law.

9. Transactions

Any transaction involving the movement of funds, e.g. switch/withdrawal, will be processed in line with the current product disclosure statement relating to your/your client's investment or policy.

10. Intellectual Property

The Site is operated for and on behalf of the OnePath Insurance entities. Copyright in the Site is owned by or licensed to the relevant OnePath entity unless otherwise indicated. This Site also contains a number of trademarks, logos and symbols which are either owned by OnePath Insurance entities or used with the permission of the owners. You are entitled to use the information in the Site for your personal reference only. Except as permitted by the Copyright Act 1968 (Cth) or other applicable laws, and as provided in section 2 above, you must not reproduce, adapt, modify, upload, download, link to, frame, perform in public, transmit or distribute any content from the Site or any part of it (in whatever form or by whatever process) unless you have obtained our prior written approval. We will not be responsible for any loss or damage arising from the above acts which are not authorised by us, nor will we be responsible for any content of other sites which are accessed via the Site.

11. Calculators and other General Advice

The information in the calculators or the Site generally should not be relied on to alter any insurance or financial arrangements without advice from a professional. This information is not a substitute for professional advice from a qualified financial adviser. We will not be liable for loss or damage arising directly or indirectly from any person relying on information provided by resulting from or omitted from the calculators. By using or accessing the information on this Site, you are also agreeing to the collection, use, storage and disclosure of your personal information in accordance with that Privacy Policy.
